The Drain
Commissioner also services as the County Enforcing Agency
for Soil Erosion and Sedimentation Control for Part 91 of
Act 451, Public Acts of 1994, Section 9101 through 9123.
The purpose is to
prevent Soil Erosion and Sedimentation and regulate
Agricultural practices (only plowing and tilling are exempt) within Newaygo County, by requiring proper
provisions for water disposal and the protection of soil
surfaces during and after construction, in order to promote
the safety, public health, convenience and general welfare
of the county and natural resources of this state.
Any earth
disturbance within 500 feet of any lake, river, stream,
creek, drain, or watercourse, etc., of this county, or any
grading stripping, excavation or filling of more than one
acre of land, requires a permit issued by the County Drain
Commissioner. Applications are to be filled our properly
and submitted to the Drain Commissioners office for
approval. Applications are available online.
The County
Resolution (#08-022-03) was adopted by the Newaygo County
Board of Commissioners on the 13th day of
