Minor Guardianship

There are two types of minor guardianships:

  Limited~ the parent’s petition and the proposed guardian and the parent(s) agree to provisions in the Limited Placement Plan. The guardian has full authority over the child except for adoption and marriage. The guardian ad litem investigates the situation and speaks with the parties involved, then gives a written report to the Judge for the file.

  Full ~ in this situation the parents have left the child with someone and they have not given the person any written authority to have the child. The person that the child has been left with can then petition to become the legal guardian. The guardian has full authority over the child except for adoption and marriage. Family Independence Agency investigates the placement.

  The petition may be filed by any adult interested in the child’s welfare or by the minor, if fourteen years or older. The child must be a resident or living with a resident of Newaygo County.


Procedure for filing a minor guardianship

1. Fill out the petition completely, signing the back. If the child is 14 or over, he/she must sign the petition and advise the court who they want as a guardian.

2. Bring the petition and fee to the Probate Court window.

3. by The following persons must be served the Petition and Notice of Hearing either mail or by delivering in person:

a) Each living parent, if the address is unknown, publication will be required in a local paper. (fees for publication vary, depending on your choice of paper).

b) The minor, if over 14 years of age.

c) Friend of the Court, if a divorce is in process.

4. Complete the Proof of Service with the name and address of each person served, date of service and whether it was by mail or personal service. The Court will NOT hold the hearing unless everyone has been served and the proof of service filed with the court.

  The process of appointing a guardian will take up to approximately 4 weeks and may require one office appointment in addition to the Court hearing.
